BREACH OF THE CODE OF CONDUCT BY AN EMPLOYEE

Throughout 2019, Grupo Paradell has seen a 180% increase in the number of investigations as a result of a complaint made through an ethical channel. It is increasingly common to outsource certain investigations to private investigation companies that are able to objectify and optimise the investigation as much as possible.

In one of these investigations, a multinational company in the technology sector had received a complaint through its ethics channel, which could indicate that one of its employees might be in breach of the company's internal code of conduct.

In this case, the employee who had commercial staff in his charge was regularly absent without justification from his professional duties, which was leading to a very noticeable decrease in the turnover of his team. In addition, a significant part of the material resources used for the work of his team were not available.

Investigations carried out by Grupo Paradell revealed that the employee was setting up and running his own business in the same sector, in breach of the company's internal code and generating a conflict of interest. It was found that these disloyal actions were carried out during working hours and using a large amount of material resources owned by our client. The client company's code of conduct expressly prohibited the use of the company's material resources for personal purposes and the exercise of other possible work activities in the same sector.

Our intervention allowed the client to solve a major problem, not only financially but also in terms of reputation, by successfully defending the case in court and dismissing the employee.
